TERMS AND CONDITIONS

These terms and conditions apply to the ARY Sahulat Wallet (hereinafter “Wallet”). You may earn ARY Loyalty (hereinafter “Loyalty,” Loyalty Points”) based on using your ARY Sahulat Wallet mobile application (“hereinafter “app”), in accordance with these terms and conditions. These terms and conditions replace and have precedence over any previous terms and conditions provided to you with respect to the Wallet. By signing, activating or using your app, you are accepting these terms and conditions.

DEFINITIONS

“Account” means ARY Sahulat Wallet Account.
“Application” or “App” means a ARY Sahulat Wallet mobile application created by the ARY Services LLC issued to and used by the accountholder.
“ARY Member” means an individual getting registered at ARY Sahulat Wallet.
“Agreement” means ARY Sahulat Wallet Terms and Conditions.
“ARY” means ARY Services LLC, which is incorporated in the United Arab Emirates (UAE).
“ARY Coins” mean ARY Coins is an ARY Loyalty Reward Unit. It is not a virtual currency.
“Card” means ARY Sahulat Card.
“Good Standing” means that you are not in violation or default of any of the terms or conditions of the Agreement, and that your Account has not been suspended, cancelled, or closed.
“ARY Loyalty Reward Unit,” “Loyalty,” “Loyalty Rewards,” or “Loyalty Points” means the points or rewards earned and/or redeemed as part of the ARY Sahulat Wallet that are earned through purchases of products and/or services of our partners.
“Milli Gold” means ARY Milli Gold that is a 24k Fine Gold 999.9.
“ARY Alliance” or “Partner” means approved manufacturer, retailer, or business participating in ARY Sahulat Wallet Loyalty.
“Program” means ARY Sahulat Wallet Loyalty Rewards Program.
“Purchases” means purchases of goods or services charged to the Account.
“We,” “our,” or “us” means the ARY Services LLC, a UAE Company
“You” or “your” means the accountholder, customer, member, or user of ARY Sahulat Wallet.
“Wallet” or “Sahulat Wallet” means a ARY Sahulat Wallet.

ELIGIBILITY

As a condition of your use of ARY Sahulat Wallet, you warrant that (i) you are at least 18 years of age with a valid phone number; (ii) you possess the legal authority to create a binding legal obligation; (iii) you will use this Wallet in accordance with these terms and conditions listed herein; (iv) you will only use this Wallet to make legitimate reservations for you or for another person for whom you are legally authorized to act in accordance with the terms and conditions listed herein, provided you accept these terms and conditions yourself as well as an agent of such other person and you will inform such other persons about the terms and conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto; and (v) all information supplied by you on this Wallet is true, accurate, current, and complete. We retain the right at our sole and absolute discretion to deny access to anyone to this Wallet and the services we offer, at any time and for any reason, including, but not limited to, for violation of these terms and conditions.
Provided your Account is in Good Standing, the Program is automatically available to you. Access to your Loyalty, ARY Coins, and Milli Gold is provided through your account. You cannot earn or redeem Loyalty (i) if your Account is not in Good Standing; and/or (ii) after the date your Account is closed. In addition, Loyalty cannot be earned and/or redeemed after the date the Program is terminated.
ARY Sahulat Wallet is strictly for personal use only. ARY Sahulat Wallet is not to be used by anyone under the age of 18, or anyone who is not a consumer. If a consumer is between the ages of 13 and 18 or a child of an ARY member, such consumer may only use ARY Sahulat Wallet through a parent or legal guardian who agrees to be bound by these terms and conditions and who otherwise qualifies herein.
Commercial Use is strictly prohibited. Non-individuals or entities such as businesses, corporations, limited liabilities companies, internships, or sole proprietorships or trusts, etc. are not entitled for membership.
Our Privacy Statement is incorporated into these terms and conditions and also governs your participation in ARY Sahulat Wallet. Please read the Privacy Statements carefully to understand how we collects, uses and discloses information about you, how to update or change your personal information, and how we communicate with you.

EARNING ARY LOYALTY, ARY COINS, AND MILLI GOLD

ARY Sahulat Wallet is a unique loyalty program, which creates a sense of savings for you. On every spending at ARY Business Alliance, you earn ARY Coins and Milli Gold through ARY Loyalty Units.
When you make a purchase of an approved merchandise or service from a Partner, you can earn a Loyalty equal to a certain percentage of the amount spent. Loyalty is then split in two benefits, ARY Coins and Milli Gold. The split of Loyalty in ARY Coins and Milli Gold is based on a certain established and announced ratio. Loyalty earned from the purchase of every merchandise varies from merchandise-to-merchandise, item-to-item, and partner-to-partner. Furthermore, the ratio split of Loyalty into ARY Coins and Milli Gold varies from merchandise-to-merchandise, item-to-item, and partner-to-partner. Please see the examples below to understand the way Loyalty is earned and split into ARY Coins and Milli Gold.
ARY SAHULAT WALLET IS NOT A CHECK, CREDIT CARD, DEBIT CARD, OR ANY OTHER CHARGE CARD. IT IS A SHOPPING LOYALTY WALLET. ANY FUNDS TOPPED UP CANNOT BE WITHDRAWN OR REDEEMED FOR CASH.
Note the differences and variations in earned Loyalty and the ARY Coins-Milli Gold ratio in the examples below.
Example 1: If an ARY member spends $100.00 at a Partner XYZ outlet, then an ARY member will get 15% of Loyalty, which is 15 Loyalty Points in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 90% | 10% ratio respectively. Thus, ARY member will get 13.5 ARY Coins and $1.50 worth of Milli Gold in Loyalty for spending $100.00 at XYZ outlet. Spot Gold price would be applicable from the loyalty platform prevailing at the time of transaction.
Example 2: If an ARY member spends $100.00 at a Partner ABC outlet, then an ARY member will get 10% of Loyalty, which is 10 Loyalty Points in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 90% | 10% ratio respectively. Thus, ARY member will get 9 ARY Coins and $1.00 worth of Milli Gold in Loyalty for spending $100.00 at ABC outlet. Spot Gold price would be applicable from the loyalty platform prevailing at the time of transaction.
Example 3: If ARY member spends $100.00 at a Partner MNO outlet, then an ARY member will get 15% of Loyalty, which is 15 Loyalty Points in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 80%/20% ratio. Thus, ARY member will get 12 ARY Coins and $3.00 worth of Milli Gold in Loyalty for spending $100.00 at ABC outlet.
Example 4: If ARY member spends $100.00 on a selected merchandise of XYZ, a partner of ARY Business Alliance, then an ARY member will get 15% of Loyalty, which is 15 Loyalty in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 90%/10% ratio. Thus, ARY member will get 13.5 ARY Coins and $1.50 worth of Milli Gold in Loyalty for the purchase of a selected merchandise of XYZ.
Example 5: If ARY member spends $100.00 on a selected merchandise of ABC, a partner of ARY Business Alliance, then an ARY member will get 10% of Loyalty, which is 10 Loyalty in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 90%/10% ratio. Thus, ARY member will get 9 ARY Coins and $1.00 worth of Milli Gold in Loyalty for the purchase of a selected merchandise of XYZ.
Example 6: If ARY member spends $100.00 on a selected merchandise of MNO, a partner of ARY Business Alliance, then an ARY member will get 15% of Loyalty, which is 15 Loyalty in the account. Loyalty will be divided into ARY Coins and Milli Gold in the 80%/20% ratio. Thus, ARY member will get 12 ARY Coins and $3.00 worth of Milli Gold in Loyalty for the purchase of a selected merchandise of XYZ.
Qualifying Purchases: ARY Loyalty is earned only when an ARY member makes a purchase of a product of a manufacturer that is part of ARY Business Alliance AND/OR the purchase is made from businesses or retailers that are approved and registered Partners as ARY Business Alliance.
NOT ALL PURCHASES MADE FROM BUSINESSES OR RETAILERS THAT ARE PART OF ARY BUSINESS ALLIANCE ARE CONSIDER QUALIFYING PURCHASES, IF THE PRUCHASED PRODUCT IS NOT FROM A MANUFACTURER THAT IS PART OF ARY BUSINESS ALLIANCE. MERCHANT AGREEMENT WITH A BUSINESS OR RETAILER WILL DETERMINE WHICH PURCHASE OF A PRODUCT IS CONSIDERED AS A QUALIFYING WHICH PURCHASE OR BUSINESS, OR A RETAILER WILL DETERMINE AT ITS DISCRETION WHICH PURCHASE OF A PRODUCT IS CONSIDERED AS A QUALIFYING PURCHASE.
LOYALTY IS NOT EARNED ON ALL PRODUCTS FROM MANUFACTURER THAT IS PART OF ARY BUSINESS ALLIANCE. MERCHANT AGREEMENT WITH A BUSINESS OR RETAILER WILL DETERMINE WHICH PURCHASE OF A PRODUCT IS CONSIDERED AS A QUALIFYING PURCHASE OR BUSINESS, OR A RETAILER WILL DETERMINE AT ITS DISCRETION WHICH HICH PURCHASE OF A PRODUCT IS CONSIDERED AS A QUALIFYING PURCHASE.
ARY Coins: ARY Coins is an ARY Loyalty Reward Unit that may be redeemed or partially be used to make purchases at https://uae.sahulatbazar.com or websites of selected Partners. 1 ARY Coin is equal to $1.00
PURCHASES WHERE PRODUCTS ARE SUPPOSED TO BE SHIPPED OR DELIVERRED TO A CUSTOMER, ARE SUBJECT TO ADDITIONAL SHIPPING AND DELIVERY CHARGES.
Milli Gold: Milli Gold is a proprietary product of ARY. It is a pure fractional gold with a gold purity of 999.9. 1 Milli Gold is equal to 0.0001 gram of pure gold.
Milli Gold has the value of pure gold according to the prevalent gold rate on ARY Sahulat Platform.
Milli Gold are made available in different denominations such as 10mg, 20mg, 50mg, 100mg, 250mg and 500mg. Redemption can be made only in multiple of given denominations.
Milli Gold Saving Scheme (MGSS): MGSS is a unique way of saving in Pure Gold on a daily basis, and you can select a plan according to your need and get gold in your account daily.
There are different denominations preset by the company to fit your needs and you can select any of the plans based on your own convenience.
• Plan 1: $1.00 per month for 20 days – 0.05 cents per day
• Plan 2: $20.00 per month for 20 days – $1.00 per day
• Plan 3: $40.00 per month for 20 days – $2.00 per day
• Plan 4: $60.00 per month for 20 days – $3.00 per day
• Plan 6: $80.00 per month for 20 days – $4.00 per day
• Plan 7: $100.00 per month for 20 days – $5.00 per day
• Plan 8: $250.00 per month for 20 days – $12.50 per day
• Plan 9: $500.00 per month for 20 days – $25.00 per day
• Plan 10: $1,000.00 per month for 20 days – $50.00 per day
Gold price is based on London PM fixing every day (Monday to Friday) and prevailing rates will be updated on ARY platform which can be reviewed through mobile application and/or website.
Gold price on ARY Sahulat platform are drawn from London PM Fixing every day, but these can vary based on many business factors.
At redemption, a member must pay Making Charges and Wastage Charges on established rates. If redemption is requested for delivery, the delivery would be made with delivery charges.
MGSS is booked everyday (from Monday to Saturday) with prevailing gold rates on ARY Sahulat platform, payment can be made either in advance, or accrued on a daily basis and to be paid at most by end of week to realize the gold booked in your wallet through MGSS.

REDEMPTION AND USE Of ARY COINS AND ARY MILLI GOLD

To redeem ARY Coins and Milli Gold, you must pay a yearly fee of $100.00 or as per prevailing Schedule of Charge. THIS FEE IS NOT A REGISTRATION FEE. ARY member can continue to earn Loyalty for every qualifying purchase. However, an ARY member cannot redeem ARY Coins and Milli Gold until the Redemption Fee is paid in full. ARY member can pay the applicable Redemption Fee either at the time of registration or at a later date, but in any event prior to redemption.
ARY member can also pay the Redemption Fee in monthly installments subject to company’s approval. The Redemption Fee in monthly installment will be $10.00 per month. Monthly installments can be paid from your ARY Coins Savings. However, ARY member can only deduct up to 20% of ARY Coins Savings as Redemption Fee.
The Redemption Fee must be paid in full within the calendar year from the date of first qualifying transaction.
If the Redemption Fee is NOT paid in full within the calendar year from the date of registration or first qualifying transaction, whichever comes first, then you will lose all the Loyalty Rewards i.e., ARY Coins, and Milli Gold.
If the Redemption Fee of $100.00 is paid upfront in full, a member becomes eligible to receive the following benefits:
• Credit Line of $10.00, limited time offer and subject to change
• 80% Loyalty, limited time offer and subject to change.
• 20% Milli Gold is converted after 250 days through MGSS. Limited time offer and subject to change
If the Redemption Fee of is paid in monthly installments, you can choose to pay either by paying the installment in USD or deduct it from your ARY Coins Savings. However, you will NOT be eligible to receive credit line of $10.00 if the chooses to pay in monthly installments.
ARY member will save on the purchase of Milli Gold by shopping from https://uae.sahulatbazar.com or websites of selected Partners

Milli Gold is pure Gold 999.9 and can be redeemed minimum in form of 10mg with making charges according to the gold market rate of the day of redemption.
ARY member may choose a delivery of the Milli Gold.
DELIVERY OF MILLI GOLD MAYBE SUBJECT TO ADDITIONAL SHIPPING CHARGES, FEDERAL TAX, AND/OR STATE TAX.

EXPIRATION

ARY Coins are valid for 18 months from the date ARY Coins are created and credited in ARY Sahulat Wallet account. The expiry date does not change with every purchase or every earned ARY Coins.
ARY Coin must be redeemed prior to its expiry date.
ARY Coin cannot be revalidated once it is expired.

LOGIN AND REGISTRATION

Certain features or services offered on or through ARY Sahulat Wallet may require you to complete a registration process and/or setup an account or login. In connection therewith, you agree to (1) provide true, accurate, current, and complete registration information, and (2) maintain and in case of any change promptly update your information to keep it true, accurate, current, and complete. You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password. You agree to notify us immediately in the event of an unauthorized use of your login, or any other breach of security. You may be held liable for losses incurred by us or any other App user or visitor due to someone else using your login as a result of your failure to keep your login information secure and confidential.
You may not use anyone else’s account or login information and we shall not be liable for any loss or damage arising from your failure to comply with your obligations listed in the terms and conditions.

• Government-issued Photo ID or Driver’s License Number
• E-Mail Address
• Cell Phone Number
• Whatsapp Number, if different from Mobile Phone Number
• City of Residence, State, and country of Residence

CURRENCY EXCHANGE

If you reside in United States of America, any qualifying purchase you make using the app registered to your account at a ARY Business Alliance Partner in the United States of America will earn you a Loyalty as if the currency were expressed in US Dollars. No currency exchange is applied to the value of your purchase for the purpose of determining how many ARY Coins and Milli Gold you have earned.

STATEMENTS

Your monthly statement for your Account (a “Statement”) will indicate the number of ARY Coins and Milli Gold and you have earned and redeemed during the billing period as well as your new ARY Coins and Milli Gold balance. This information can also be obtained from your mobile application or web using your account credentials. It is your responsibility to verify the information regarding Loyalty on each Statement and notify us promptly of any errors. In the event of an error, our only responsibility is to correct the error. If you do not notify us in writing within thirty (30) days from the Statement date, we will deem the information regarding Loyalty, ARY Coins, and Milli Gold on your Statement are correct. However, we reserve the right to adjust the Loyalty, ARY Coins, and Milli Gold on your Account if we have improperly credited Loyalty, ARY Coins, and Milli Gold to your Account or otherwise in accordance with these terms and conditions. Our records of Loyalty, ARY Coins, and Milli Gold earned and redeemed will be final, conclusive and binding on you.

HOW WE COMMUNICATE WITH YOU

We will communicate with you in connection with this Program via e-mail or notification on the ARY Sahulat Wallet app or generic information like schedule of charge and specification and change in product features and promotional benefits would be displayed on website [web url. www. ]

TERMINATION

These terms and conditions will remain effective until we modify or terminate the same. We may terminate this Program, your account, or your ability to use the app or any portion thereof immediately, without notice to you, at any time and for any reason, with or without cause, including but not limited to if, in our sole and absolute discretion, you fail to comply with any of these terms and conditions of use or engage in any fraudulent, criminal, or other unauthorized activity. We may also close and terminate your account due to inactivity. Notification, if any, under this section will be via e-mail or notification on the ARY Sahulat Wallet app.

CHANGES TO THESE TERMS AND CONDITIONS OR PROGRAM

From time to time, we may amend, modify, or change the Program terms and conditions at any time without notice to you, including, without limitation, the terms and conditions that apply to the earning, calculation, and redemption of ARY Sahulat Wallet. The current version of the Program terms and conditions is available online at https://uae.sahulatbazar.com.
We also reserve the right to terminate or suspend the ARY Sahulat Wallet and cancel any earned Loyalty, ARY Coins, and Milli Gold without any prior notice to you at any time.
All ARY Sahulat Wallet affiliation as member or Partners are subject to acceptance of prevailing terms and conditions available in product documents, promotions, letters and communications. These guidelines, terms and conditions are inclusive of all amendments and newly introduced terms from time to time. Any contradiction in any aspect of the product or benefit feature should be decided by the ARY Sahulat Wallet at its sole discretion.
If we end the ARY Sahulat Wallet Loyalty you have earned but not used, then it will expire on the end date, and you may not redeem any Loyalty or use any credits after the end date. Any changes or modifications in the ARY Sahulat Wallet will be effective immediately or as prescribed in the respective updates upon posting the revisions here or on https://uae.sahulatbazar.com, and you waive any right you may have to receive specific notice of such changes or modifications.

GOVERNING LAW

ALL ISSUES AND QUESTIONS CONCERNING THESE TERMS AND CONDITIONS OR THE RIGHTS AND OBLIGATIONS OF MEMBERS OR PARTICIPANTS AND IN CONNECTION WITH THE PROGRAM SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE UAE WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE OR COUNTRY’S LAWS.

LIMITATIONS OF LIABILITY

A COVERED PARTY (AS DEFINED BELOW) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, ECONOMIC, OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES AND LOST PROFITS OR SAVINGS) IN ANY MANNER DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THIS PROGRAM, REGARDLESS OF ANY NEGLIGENCE OF ANY COVERED PARTY. ARY SAHULAT WALLET IS NOT RESPONSIBLE FOR ANY LOSS OF ASSETS OR LIVES WHATSOEVER ASSOCIATED DIRECTLY OR INDIRECTLY WITH THE PRODUCT OR SERVICES BEING OFFERED WHATSOEVER.
“Covered Party” means ARY Services, LLC, or our affiliates, subsidiaries, or any and any officer, director, employee, subcontractor, shareholder, member agent, successor, or assign of ARY.

ARBITRATION

INDIVIDUAL CLAIMS AND DIRECT DAMAGES ONLY

Before you file a lawsuit, you must send us sixty (60) days written notice, and the parties must enter into mediation via zoom or other electronic means with a mediator located in the UAE under the laws of the UAE.
AS A CONDITION OF PARTICIPATING IN THIS LOYALTY PROGRAM, YOU AGREE THAT ANY AND ALL DISPUTES WHICH CANNOT BE RESOLVED BY THE PARTIES, AND CAUSES OF ACTION RELATING TO, OR ARISING OUT OF OR IN CONNECTION WITH THIS PROGRAM, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, EXCLUSIVELY BEFORE A COURT OF COMPETENT JURISDICTION LOCATED IN THE UAE. Furthermore, in any such dispute, participants will not be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental, or consequential damages, including attorneys’ fees, and you further waive all rights to have damages multiplied or increased.

SEVERABILITY

The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision in the terms and conditions is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

NO WAIVERS

Our failure to enforce any provision of these terms and conditions will not constitute a waiver of that provision.

ASSIGNMENT

We may assign, transfer or sell our rights, benefits or obligations under these terms and conditions to a third-party and you consent to this without us having to notify you. If we do so, or if we are considering doing so, you agree that we can disclose information about you and your account, including information about ARY Sahulat Wallet in connection with your account to the third party or related party.

TAXES

You are solely responsible for any tax liability related to your receipt of benefits of ARY Sahulat Wallet and your participation in the Loyalty Program. We do not issue tax receipts.

COMPLIANCE

ARY Sahulat Wallet is not responsible for creating a remedy for your ineligibility, disqualification, bar from law enforcement agencies, or control lists. You shall be deemed disqualified and you shall forfeit your right to claim such reward or any relevant legal recourse.
ARY Sahulat Wallet possesses a sole right to cease any relationship with you based on any findings of Money Laundering, payments against ransom or other illegal, unlawful, or banned activity or any activity that we find to be against social interests of the society.

You may also choose to permit us to access information directly from your device, such as information in the device’s “contacts list". The term “your device” as used in this Privacy Policy refers to any computer, tablet, smart phone or other device you are using to access our websites or to operate the ARY Sahulat Wallet mobile applications. For more information about mobile application permissions, please see the ARY Sahulat Wallet mobile applications section below.
You may also in some instances provide us information about other people, such as name, phone number and email address, including when you direct us to send someone a gift card or e-gift. 2. Information We Collect Automatically

Purchasing Information – We may collect information about your transactions in our stores, on our websites or via our ARY Sahulat Wallet mobile applications including what products you purchase, how frequently you purchase them, any Loyalty or promotions associated with a purchase, and the products you have placed on your “Wishlist" or “My Bag" for future purchase.

This information may include the type of device you are using, your operating system, your browser, your internet service provider, your domain name, your internet protocol (“IP”) address, your device and mobile ad identifiers (e.g., Apple IDFA or Android AAID), the website that referred you to our website, the web pages of our website that you view (including the date and time you viewed them), the services or functionality you access or use (including the date and time of your access or use), and the subject of the ads you click or scroll over. To collect this information, we may use log files that record events in connection with your use of our services, as well as cookies and similar technologies, such as web beacons embedded in marketing emails to monitor the engagement of recipients.

Information We Collect from Other Sources

Some information we collect is from unaffiliated sources, including in some cases information that is publicly available, provided by or purchased from marketing business partners, or present on social media platforms.
For example, we may collect information you submit to a blog, a chat room, or a social network like Facebook or Twitter. We may also collect or license information about you from other companies and organizations, such as information aggregators or event or promotion co-sponsors, including to supplement information that we receive from you. We may also in some cases receive information about you from ARY-affiliated entities, which we handle in accordance with this Privacy Policy. By gathering additional information about you, we can correct inaccurate information, enhance the security of your transactions and help prevent fraud, and give you product recommendations and special offers that are more likely to interest you.
Some examples of when we collect this information include when you browse or make a purchase on one of our websites or mobile application; create a ARY account; use our website or mobile application to purchase, reload or redeem a ARY Coins or Milli Gold; use the order and pay functionality in our mobile applications; buy or send a gift card or e-gift; or participate in a survey or promotion.

By downloading, installing, accessing or using the Application, you (the “User”) consent to all actions that we take with respect to your data consistent with our Privacy Statement. Use of the Application entails information collection in accordance with the Information We Collect section above, and includes user controls for Application functionality, such as location services, purchasing e-gifts, and setting push notification and in-app message preferences.
1. User Information Through the use of an iOS, Android or other supported hardware device, some functionality of the Application may require the transmission of certain information provided by you, including but not limited to:
• username and password;
• e-mail address;
• billing address;
• phone number;
• financial information, such as payment card numbers or account numbers;
• information related to an ARY Sahulat Wallet;
• voice; and
• GPS location (together, “User Information”).
As described further below, certain optional information may also be shared with ARY through the ARY Sahulat Wallet mobile application, including:
• Personalized messages for individuals to whom you would like to purchase and send a ARY gift card (“eGift”), and names and email addresses from a device’s “contacts” list if you choose to import a recipient’s contact information from there;
• Advanced analytics information such as location data, diagnostic and usage data, and user interactions;
• Location-based information, such as through GPS, Bluetooth-enabled iBeacons, or other location-based technology to enhance the user experience so that you may order ahead, receive directions, and see what is available at nearby stores; and
• The day and month of your birthday, so that we may recognize you on your special day (we don’t ask for your birth year for this).
2. Controlling Application Functionality a. Location Services - In order to use certain Application functionality, such as MOP and location-based services and technology, you must either (a) enable “location services” in the Application; and/or (b) set the permissions in your mobile device to allow communication of this information. More information about adjusting location services on iOS devices may be found here, and additional information on managing an Android device’s location settings may be found here.
b. If you allow for location sharing, your device may communicate with us in ways that allow for us to customize your experience using ARY Sahulat Wallet application, to monitor the effectiveness of our marketing efforts, to tailor messages based on your time and location patterns, and to limit the number of times you see a promotional message or offer.
c. Voice Ordering - In order to use certain Application functionality such as Voice Ordering, when available, you must (a) enable “microphone” and “speech recognition” in the Application; and/or (b) set the permissions in your mobile device to allow communication of this information.
d. If you use such Application functionality, including location services and voice ordering, you consent to the transmission of User Information to ARY and/or its agents, and authorize ARY and/or its agents, to record, process, and store such User Information as necessary for the Application functionality and for purposes described in the ARY Privacy Statement. Please see the rest of this Privacy Statement for more information about how we may use and store personal information, and how to opt out of sharing personal information.
e. eGifts - If you choose to use Application functionality that allows you to send messages or eGifts to third parties, you must first obtain their permission to provide their personal information, such as their name, phone number or email address, to us. The referred information will be used by us for the purpose of contacting the third party, on your behalf, to carry out the requested functionality, for example, by emailing an eGift. Although you may enter the recipient’s contact information into the Application, you also have the option to provide the recipient’s contact information by granting us permission to access your device’s contacts.
3. User Responsibility We do not have control over our partner’s stores o payment devices. You are solely responsible for maintenance of the confidentiality and security of your User Information which you transmit from or store on a Device for purposes of the Application, including Mobile Payment, MOP and Voice Ordering, and for all transactions and other activities undertaken with any Card registered in your name, whether authorized or unauthorized. You agree to immediately notify us of any unauthorized transactions associated with the Application including Mobile Payment, MOP, Voice Ordering, or any other breach of security. We shall not be responsible for any losses arising out of the loss or theft of User Information which you transmit from or store on a Device or from unauthorized or fraudulent transactions associated with the Application.
4. Email Communications, Push Notifications, and In-App Messages The Application allows all users to set preferences for receiving promotional email communications from us, receiving push notifications on your device, and receiving inbox messages. Please note as well that you may opt-out of receiving email communications at any time by adjusting your ARY online account settings as described in the How to Manage Your Account Settings section below, or by clicking the “unsubscribe” link included within any commercial email we send you.
Your Choices: You have control over your promotional communications preferences, mobile application functionality, cookie settings, interest-based advertising preferences, Flash cookies, and more.

Promotional Communication Choices You can opt out of receiving promotional emails and mailings by informing us of your preference at the time you sign up for a ARY account, by modifying your promotional preferences online in your account’s profile management section, or by following the “unsubscribe” instructions in the promotional emails we send you. Similarly, you may opt in to receive text messages, telephone calls and mailings. Please note that if you opt out of receiving promotional communications from us, we may still send you transactional communications, including emails about your ARY accounts or purchases.
a. Mobile Functionality – As described in the ARY Mobile Applications section above, location services, push notifications, and voice transmissions may be adjusted or disabled within your device settings.
b. Cookies, Web Beacons and Similar Technologies – You may be able to reject cookies, web beacons, entity tags and HTML5 local storage by adjusting the appropriate settings in your browser. Each browser is different, but many browsers have preferences or options that may be adjusted to allow you to either accept or reject cookies and certain other technologies before they are set or installed or allow you to remove or reject the use or installation of certain technologies altogether. ARY Sahulat Wallet will not discriminate against you in the event you exercise any of the aforementioned rights under CCPA, including, but not limited to, by:
